Documents filed in the Supreme Court on Friday argue the Special Commission of Inquiry report by former High Court judge Michael McHugh should be disregarded.

The report found as many as 68,000 greyhounds were slaughtered as "wastage" in the past 12 years "because they were considered too slow to pay their way or were unsuitable for racing".

It recommended the NSW Parliament decide whether the industry has lost its social licence and should be no longer able to operate.

Mr Baird announced the industry would be closed from July 1 next year.

The summons filed in the Supreme Court seeks a declaration that Mr McHugh's report be declared invalid because it was unreasonable, lacked procedural fairness and went beyond the terms of reference.

It says the court should find the report was unreasonable to consider the issue of a social licence because it would not be admissible in civil proceedings, one of the requirements of the Special Commission of Inquiry Act.

It also argues the wastage figures in the report are "irrational".

Brenton Scott, chief executive of the NSW Greyhound Breeders, Owners and Trainers Association, said Mr Baird's decision was based on just one of 80 recommendations in the report.

"The idea that a government can ban a perfectly lawful racing industry ... on the basis that it has lost some form of 'intangible and unwritten' social licence, would be a very worrying development to many in the community," he said.

Acting Premier and Racing Minister Troy Grant said the industry "should have invested as much time and resources into ridding itself of live baiting and animal cruelty as it is now spending on lawyers, lobbyists and spin doctors".
